THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6779 OF 2023 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No. 154 of 2023 pending on the file of Station House Officer, Moinabad Police Station, Cyberabad, Rangareddy District registered for the offences punishable under Sections 498-A, 306 of Indian Penal Code (for short "IPC").

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case in brief are that the petitioner was arrested for harassing his wife for additional dowry, resulting in the wife committing suicide. The father of the deceased lodged complaint stating that the marriage of the deceased with the petitioner performed in the year

2002. At the time of marriage the parents of the deceased gave Rs.1,00,000/- cash, 3 tulas of gold as dowry. However, the petitioner started harassing the deceased for money, physically and mentally. Unable to bear the harassment, she committed suicide.

Learned counsel appearing for the petitioner would submit that bald allegation is made by the father-in-law stating that the deceased used to inform him about the harassment on phone. Even, according to the complaint there was never any direct demand made by the petitioner either with the de-facto complainant or anyone else.

Keeping in view that the petitioner was arrested on 08.06.2023 and the investigation is almost completed, this Court deems it appropriate to enlarge the petitioner on bail subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a

like sum each to the satisfaction of Metropolitan Sessions Judge, Cyberabad, Rangareddy District at L.B. Nagar.

ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer on every Monday starting from 07.08.2023 for a period of eight weeks from the date of this order. It is needless to say, he shall appear before the concerned Court for the purpose of completion of trial.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
