ORDER:

The petitioners, who claimed to have made applications for being considered for appointment as fair price shop dealers for Nizamabad Urban, filed this Writ Petition for a Mandamus to declare the inaction of the respondents in proceeding further with the filling up of vacancies notified, vide proceedings No.B3/3366/2007, dated 23.8.2008, of the Revenue Divisional Officer, Nizamabad, as illegal and arbitrary. No counter-affidavit is filed by the respondents. Learned Government Pleader for Civil Supplies (Telangana) submitted that due to certain administrative exigencies, the

vacancies of fair price shop dealers notified under the abovementioned proceedings have not been filled up so far. In my opinion, when a notification is issued inviting applications for filling up of vacancies of fair price shops on permanent basis, the competent authority is bound either to proceed with such filling up of vacancies or in the event it decides not to proceed with the selection process, it shall communicate such decision to the public through publication in media. Therefore, respondent No.2 is directed to consider whether the permanent vacancies of fair price shops notified under the above-mentioned proceedings of the Revenue Divisional Office, Nizamabad, shall be filled up or not. In the event, a decision to fill up the said vacancies is taken, he shall instruct the Revenue Divisional Officer, Nizamabad to complete the process in a time bound manner. In a converse case, the decision shall be communicated to the petitioners.

Subject to the above directions, the Writ Petition is disposed of.
