HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3455 OF 2017 ORDR:

The present petition, under Section 482 of the Code of Criminal Procedure (for short, 'the Code'), is filed requesting to quash the proceedings in Crime No.5 of 2017 of Tandur Police Station, R.R. District.

The petitioners 1 to 3 herein are arraigned as accused Nos.1 to 3 in the aforesaid Crime. They alleged to have committed the offences punishable under Sections 354, 384, 504, 506 & 109 of IPC. 3.

Heard Sri Shakeel Ahmed, the learned counsel for the petitioners, and the learned Additional Public Prosecutor for the State of Telangana.

Now, the main submission of the learned counsel for the petitioners is to direct the Investigating Officer to follow the procedure inlaid by the provisions of Section 41-A of the Code giving up the main relief of quashment. Since the alleged offences are punishable with imprisonment not exceeding seven years, the Investigating Officer is directed to follow the procedure under Section 41-A of the Code and also the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1. 5.

Criminal Petition is accordingly disposed of. 1 (2014) 8 SCC 273

As a sequel thereto, miscellaneous petitions, if any, pending in the Criminal Petition shall stand closed.
