HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2243 OF 2015 O R D E R:

This writ petition is filed seeking Writ of Mandamus declaring the action of the 2nd respondent in not considering and disposing of the petitioner's representation dated 12.01.2015, as illegal and arbitrary. The case of the petitioner is that the petitioner was issued eviction notice dated 16.12.2014 under A.P. Land Encroachment Act (for short 'the Act') and later when the competent authority issued eviction proceedings on 10.01.2015, the petitioner filed an appeal before the 2nd respondent. Though, no interim orders are passed in the appeal, the respondents are trying to evict the petitioners.

Heard the learned counsel for the petitioner, learned Government Pleader for Irrigation and Sri Ravi Cheemalapati, learned Standing counsel for respondents 6 and 7.

In view of the fact that the statutory appeal is pending before the 2nd respondent, the petitioner can raise all his contentions before the 2nd respondent and the 2nd respondent is directed to consider the same and pass appropriate orders in accordance with law. Till then, status-quo shall be maintained.

With the above direction, this Writ Petition is disposed of. The miscellaneous petitions, pending if any, shall stand disposed of. There shall be no order as to costs.
