HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 16952 of 2016 Order:

It is the case of the petitioner that Sri Lakshminarayana Temple is located in Devi Road, Nizamabad. Adjacent to the said Temple, there is Hanuman Temple. The petitioner says that the said Temples are nearly 100 years old. The petitioner has been performing the duties of Poojari of the said Temples for more than four decades. Prior to the petitioner, his ancestors performed the poojas. While so, when the proceedings dated 27.04.2016 were issued by the Assistant Commissioner, Endowments Department, Nizamabad, permitting the Founder Trustee of the Temple to retire the petitioner on attaining the age of superannuation of 65 years on 30.04.2016, the present Writ Petition was filed.

A reading of the impugned order shows that the said proceedings were issued on the letter of the Founder Trustee seeking permission to retire the petitioner from Temple service on attaining the age of 65 years. The learned counsel for the petitioner could not show any rule permitting the continuance of the petitioner beyond 65 years. The only ground raised by the learned counsel for the petitioner is that if the Temple is without Poojari there will be nobody to look after the Temple. It is for the Founder Trustee and the authorities of the Endowments Department to look after the affairs of the Temple, but the impugned order permitting the Founder Trustee to retire the petitioner from Temple service cannot be found fault with.

3. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________
