HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19036 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents particularly respondent no.2 and 3 in not considering the representations of the petitioner dated 01.04.2017, 7.1.2018, 27.08.2018 and 24.04.2019 requesting to cancel the house numbers allotted in favour of the unofficial respondents who illegally grabbed the petitioners property to an extent of Ac 0.30 gts in Survey no.

491/3 situated at Reddypalem Village, Geesugonda Mandal, Warangal Rural District is illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19, 21 and 300-A of Constitution of India and consequently direct the respondents to consider the representations of the petitioner dated 01.04.2017, 7.1.2018, 27.08.2018 and 24.04.2019 in the interest of justice and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard Sri Gadipe Prashanth, learned counsel appearing for the petitioner, learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, Smt Pingali Laxmi, learned Standing Counsel appearing for respondents 2 & 3, learned Government Pleader for Revenue appearing for the 4th respondent and learned Government Pleader for Home appearing for the 5th respondent. Perused the material available on record.

It is the allegation of the petitioner that respondents 6 to 37 have illegally occupied the land over an extent of Ac. 0.30 guntas in Survey No.491/3, situated at Reddypalem Village, Geesugonda

CKR, J W.P.No.19036 of 2019 Mandal, Warangal Rural District, and the house numbers were also been allotted to them.

The petitioner asserts that since the unofficial respondents are in illegal occupation of the petitioner's land, the granting of house numbers in their favour is unauthorized and illegal. The petitioner further asserts that she submitted representations, dated 01.04.2017, 07.01.2018, 27.08.2018 and 24.04.2019, to the official respondents to cancel the house numbers allotted to the unofficial respondents, who illegally grabbed the petitioner's subject property, but the same are not being taken into consideration and disposed of by the official respondents.

Smt. Pingali Laxmi, learned Standing Counsel appearing for respondents 2 & 3, on instructions, would submit that she has received oral instructions that no house numbers have been granted in favour of respondents 6 to 37.

Having considered the submissions made by both the learned counsel and taking into consideration the assertion made by the learned standing counsel that no house numbers have been allotted to the unofficial respondents, this Court is of the view that no cause survives for adjudication in this writ petition. However, since the petitioner's allegation is non-consideration of the representations, dated 01.04.2017, 07.01.2018, 27.08.2018 and 24.04.2019, submitted to the official respondents to cancel the house numbers allotted to the unofficial respondents, who illegally grabbed the petitioner's subject property, the factum whether any house numbers have been granted to the unofficial respondents or not can be informed to the petitioner in writing.

With the above observations, the Writ Petition is disposed of directing respondents 2 & 3 to communicate to the petitioner in writing the factum whether any house numbers have been granted to respondents 6 to 37 or not. No order as to costs. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
