2019-12-16P.Keshava Rao2 pages

HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.18346 of 2014 ORDER:

There is no representation on behalf of the petitioners. The prayer sought in the writ petition is as under: "... to issue a writ or order or direction in the nature of writ of mandamus declaring action of the 2nd respondent frequently making attempts to harassing the petitioners and their family members is illegal, arbitrary and violation of principles of natural justice and against the personal liberty of the petitioners and consequently direct the respondents not to harass the petitioners and their family members."

Learned Government Pleader appearing for respondent Nos.1 and 2 placed on record written instructions dated 16.12.2019 issued by the Assistant Sub-Inspector of Police, Kukatpally Police Station, Cyberabad Commissionerate. From a perusal of the said written instructions, it is revealed that on the complaint of the 3rd respondent a case in Crime No.438 of 2014 was registered under the heading "girl missing" of Kukatpally Police Station. In the said complaint, the complainant has stated that her daughter is missing and requested to take action. During the course of investigation, the petitioners were enquired about the missing girl. Except doing investigation, the respondent police never harassed the petitioners or their family members at any point of time. It is also mentioned in the written instructions that on the point of jurisdiction the crime was transferred to Jagadhgirigutta Police Station.

In view of the above said specific averments made in the written instructions, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.

Miscellaneous petitions, if any, shall also stand dismissed.
