THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.37667 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners are aggrieved by the rejection of their application for grant of pattadar passbooks and title deeds by the Tahsildar, Kovur, SPSR Nellore District, the 4th respondent, under endorsement, dated 29.10.2010, whereunder, he directed them to approach the civil Court. Pursuant thereto, they are stated to have filed a suit for declaration in O.S.No.154 of 2011 before the Senior Civil Judge, Kovur. While so, the very same 4th respondent is stated to have granted pattadar passbooks and title deeds to respondents 4 and 5 and the same is questioned in this Writ Petition on the ground that no appeal lies against the said order as per the latest judgment of the Division Bench of this Court.

Even if that be so, the petitioners have a remedy under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act'), and the revisional authority can always examine the matter and issue appropriate orders. Hence, there is no reason to entertain the Writ Petition under extraordinary jurisdiction.

With the liberty to the petitioner to avail the remedy available under the Act, the Writ Petition is disposed of. There shall be no order as to costs.
