HCJ & AAR, J W.A. No. 728 of 2019 Dt: 13-09-2019 Judgment: (per Hon'ble The Chief Justice Raghvendra Singh Chauhan) The appellant, who is a third party, has challenged the legality of the order dated 10-07-2018, passed by the learned Single Judge, in W.P. No. 32428 of 2014, whereby the learned Single Judge has directed the respondent No. 15, Society or its members to deposit the enhanced compensation to the credit of E.P. Nos. 4 and 5 of 2014 on the file of the Senior Civil Judge, Mahabubnagar.

The appellant is the purchaser of certain property covered by the aforesaid EPs from one B. Shanker Singh, a member of the respondent No. 15, Society. During the course of hearing of this case, he has filed an undertaking dated 12-09-2019, that he is willing to deposit an amount of Rs.3,87,353/- (Rupees three lakhs eighty seven thousand three hundred and fifty three only) before the EP Court within two months from the date of this order. The said undertaking is placed on record. Therefore, the appellant is directed to deposit the aforesaid amount before the EP Court within a period of two months from today. However, in case the appellant fails to deposit the said amount within the stipulated period before the EP Court, the respondents are free to take action against him in accordance with law.

With these directions, this writ appeal stands disposed of.
