THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.875 OF 2017 ORDER:

This petition is filed by the petitioner under Article 226 of the Constitution of India seeking to recall the look out circular issued against him by the XIII Additional Chief Metropolitan Magistrate, Hyderabad, in C.C.No.252 of 2012.

Heard and perused the material available on record. The petitioner is alleged to have committed the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Learned Counsel for the petitioner submitted that as NBWs were issued against the petitioner, he filed Crl.P.No.1410 of 2016 earlier before this Court and this Court directed the petitioner to surrender before the Magistrate concerned and file a petition to recall NBWs issued against him vide order dated 11.2.2016, which was amended on 12.8.2016. But now, the petitioner came to know that look out circular was issued against him and therefore, he is unable to surrender before the Court concerned. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The lookout notice issued against the petitioner is hereby recalled so as to enable him to appear before the Court concerned on or before 20th March, 2017."

Accordingly, the Writ Petition is disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 5th January, 2017 Nn
