HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 9155 of 2007 ORDER:

This writ petition is filed by the Petitioners questioning the Order of the 1st Respondent, dated 07.03.2007 in Rc.No.2378/ 2006 passed under Sec.5 of the Land Acquisition Act. 2.

The Sec.4(1) notification was issued proposing to acquire the land of the petitioners in an extent of Ac.1.74 cents in Sy.No.148/ 1 of Edugundlapadu village, Maddipadu mandal, Prakasam district. 3.

The writ petition is admitted on 27.04.2007. Today, when the matter came up for hearing the learned Government Pleader for Land Acquisition placed on record the latest written instructions of the Tahsildar, Maddipadu, dated 06.12.2017. According to the said instructions, it is proposed to acquire the land of the petitioners to an extent of Ac.1.74 cents in Sy.No.148/ 1 of Yedugundlapadu village for providing house sites to the weaker section people of the village. The Tahsildar, further, submits that now the selected beneficiaries in the village of Yedugundlapadu are not at all residing in the said village and hence the above said land proposed under acquisition is not at all required for the said purpose.

In view of the same, recording the said submissions made on behalf of the respondents, as the subject land is no more required for acquisition purpose, no further orders are required to be passed in the writ petition.
