HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 34134 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not considering the case of the petitioner for appointment on compassionate grounds as illegal arbitrary.

It is the case of the petitioner that her husband by name late Sri P.Kantha Reddy, was selected and was appointed as a Cleaner in Sri Govindaraja Swamy (SGS) Arts College Hostel, TTDs Tirupati vide appointment order dated 31.01.1992. That the husband of the petitioner died on 04.04.2011, while he was working in TTD services. The petitioner made representations on 06.04.2012 and also on 30.03.2015 on behalf of her son for providing employment to her son, which was rejected on the ground that the son of the petitioner has not attained the age of majority. Thereafter, petitioner made another representation dated 30.07.2015 for considering her case and also to provide employment in TTD on compassionate grounds. As no orders are passed, present writ petition is filed.

Heard learned counsel for the petitioner and Sri G.Praveen Kumar, learned counsel representing Sri A.K.Jayaprakash Rao, learned Standing Counsel for the respondent.

Learned counsel for the petitioner submits that services of petitioner's husband were regularized vide proceedings dated 25.10.2004. He submits that even family pension was also paid to the petitioner after the death of her husband, as such, respondents cannot deny the compassionate appointment of the petitioner only on the ground that the proposals regarding regularization are pending with the Government. When once the services of the husband of the petitioner were regularised in the year 2004 and the petitioner was paid family pension after the death of her husband, the respondents cannot deny the compassionate appointment of the petitioner. In view of the same, the respondent authorities are directed to consider the representation of the petitioner dated 30.07.

2015 for compassionate appointment and take action in terms of the scheme framed in that regard, within a period of two months from the date of receipt of a copy of this order. With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. _________________________ A.
