THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.16768 of 2018 ORDER:

The writ prayer is completely in anticipation of respondents refusing to consider the objections raised by the petitioner.

Once a lis in any form is pending before the respondents, they are under obligation to follow the procedure. For any reason, the apprehension of petitioner transpires into reality, the remedies available in law can be pursued.

This Court is of the view that in apprehension and in anticipation of an omission by respondents, a direction more in the nature of precautionary principle cannot be issued.

The writ petition is dismissed with the above observations. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
