HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Criminal Petition No. 3649 of 2015 Order:
The instant petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, by the petitioners, who are arraigned as A-7 and A-8 respectively, requesting to quash the proceedings in Crime No.55 of 2015 of Kukatpally Police Station, Cyberabad Commissionerate, Hyderabad, registered for the offence punishable under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2. When the accused Nos.1 to 3, 5 and 6; namely Panduga Sattiah, Panduga Raju, Panduga Narsing Rao, Panduga Hanumantha Rao and Panduga Narsing Rao, filed Criminal Petition No.2293 of 2015 seeking the very same relief, as the one which the petitioners herein are seeking, this Court, by an order dated 06.04.2015, in the said criminal petition, while holding that it is not a fit case to quash the proceedings and investigation shall continue to its logical end and since the learned counsel therein represented that the case mainly involves in survey dispute and civil in nature, directed the police of Kukatpally Police Station, Hyderabad, not to arrest the petitioners/A-1 to A-3, A-5 and A-6 in FIR No.55 of 2015 during the course of investigation.
Since the petitioners herein also stand on the same footing as that of the petitioners/A-1 to A-3, A-5 and A-6 in Crl.P. No.2293 of 2015, the police of Kukatpally Police Station, Hyderabad, are directed not to arrest the petitioners/A-7 and A-8 respectively, in FIR No.55 of 2015 during the course of investigation, but, the petitioners shall co-operate with the investigating agency for smooth completion of the investigation.
3. Accordingly, the Criminal Petition is disposed of.
4. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed.
