HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 20840 OF 2004 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner is challenging the orders passed in ID No.108 of 1999 wherein no relief was granted to the petitioner and the petitioner is seeking relief against the 2nd respondent and the Writ Petition against the 2nd respondent was dismissed for default vide orders dated 29.12.2010 and no steps have been taken by the petitioner to ensure that the Writ Petition against the 2nd respondent is restored. In the absence of 2nd respondent, this Writ Petition cannot be adjudicated on merits.

The learned Standing Counsel, appearing for the 3rd respondent submits that similar issue fell for consideration before this Hon'ble Court in WP No.26652 of 2005 and this Hon'ble Court was pleased to dismiss the said Writ Petition on merits, vide orders dated 26.9.2018. The learned Counsel, appearing for the petitioner, also fairly concedes that identical Writ Petition was dismissed by this Hon'ble Court.
