HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.2600 & 27148 of 2011 COMMON ORDER:
When these matters are taken up for hearing, both the counsel have informed the Court that the issue raised in these writ petitions is squarely covered by the judgment of this Court in W.P.No.18911 of 2009, dated 25.10.2018, and in view of the same, the punishments imposed in the present writ petitions also can be modified from deferment of annual increments for a period of two years with cumulative effect, imposed by the appellate authority be modified to that of deferment of annual increments for a period of two years without cumulative effect and without monetary benefits.
In view of the above submission, these writ petitions are disposed of, modifying the punishment imposed by the appellate authority from deferment of annual increments for a period of two years with cumulative effect, to that of deferment of annual increments for a period of two years without cumulative effect, however, without monetary benefits. No order as to costs.
