JUDGMENT: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The appellant is aggrieved by the order dated 26.07.2019 passed by a learned Single Judge in W.P.No.15765 of 2019, whereby the learned Single Judge has issued notice to the respondent No.4, and has clearly ordered that "any promotion of the respondent No.4 would be subject to the result of this writ petition". This Court has asked the learned counsel for the appellant, Mr. P.V. Krishnaiah, as to how the appellant is aggrieved, especially when the impugned order clearly states that any promotion of the respondent No.4 is subject to the decision of the writ petition? To this pointed query, the learned counsel for the appellant submits that despite the service of notice upon the respondent No.4, she has yet to appear before the learned Single Judge. In fact, according to the learned counsel, the case has not been listed so far before the learned Single Judge. Therefore, the appellant is aggrieved by the impugned order.

This Court has also asked the learned counsel for the appellant whether any application for early hearing has been moved before the learned Single Judge for deciding the case? To this query, the learned counsel has frankly conceded that no such application has been filed before the learned Single Judge.

Therefore, this Court fails to understand as to how the appellant is aggrieved by the impugned order, especially when it clearly states that if any promotion were given to the respondent No.4, the said promotion shall be subject to the decision of the writ petition.

For the reasons stated above, this Court does not find any merit in the present writ appeal; it is hereby dismissed. There shall be no order as to costs.
