THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6877 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.59 of 2023, on the file of Bela Police Station, Adilabad District, registered for the offences under Sections 498-A and 307 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
Earlier, the petitioner had moved this Court for grant of anticipatory bail vide Crl.P.No.5583 of 2023. This Court by order dated 07.07.2023 after discussing the allegations against the petitioner found that it was a fit case to grant anticipatory bail.

However, learned counsel for the petitioner would submit that even before the order could be
communicated, the petitioner was arrested on 07.07.2023. Since this Court has found that it was a fit case for grant of anticipatory bail, regular bail can be granted to the petitioner for the reasons stated in Crl.P.No.5583 of 2023 subject to the following conditions: i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial Magistrate of First Class, Adilabad District.
ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer every Monday between 10.30 AM and 01.00 PM for a period of eight weeks from the date of this order. It is needless to say, he shall appear before the concerned Court for the purpose of completion of trial.
iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
