Heard learned counsel for the petitioner, learned Government Pleader for Medical and Health for respondents 1 and 2, Sri P.V. Krishnaiah, learned counsel for respondent No.3 and Sri C. Srinivasa Babu, learned standing counsel for respondent No.4.

Petitioner is aggrieved by the determination of her seniority vis-a-viz the unofficial respondent in the cadre of Assistant Director. She contends that though her date of regularization as Assistant Director was 06.08.2008, it was erroneously shown as 18.08.2008 on which date regularization was granted to the unofficial respondent and there is no prior notice or opportunity before altering the date of regularization and therefore in the seniority list, she cannot be shown as Junior to the unofficial respondent. Ventilating her grievance on the issue of wrong reflection of seniority assigned to her and unofficial respondent, petitioner addressed a representation to the Director, Public Health and Family Welfare, on 09.08.2019 marking a copy to the Principal Secretary to Government, Medical and Health Department.

Learned counsel for the petitioner alleges that petitioner took time for obtaining all the material and thereafter addressed a representation to the Director, Public Health and Family

Welfare, marking a copy to the Principal Secretary to Government.

Without entering into the merits and having regard to the fact that the representation addressed was also marked to the Principal Secretary to Government, the Principal Secretary to Government is directed to treat the representation dated 09.08.2019 as an appeal and after affording due opportunity to both the petitioner and unofficial respondent, shall consider the inter se claim of seniority and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. It is open to the unofficial respondent to raise all pleas as available in law in response to any notice issued by the appellate authority.
