ORDER:

This writ petition is filed for a mandamus to direct respondent No.1 to consider the petitioner's representation, dated 01.12.2008, for appointment as regular fair price shop dealer.

At the hearing, the learned counsel for the petitioner submitted that pending this writ petition, the respondents have considered his client's representation and appointed him as the permanent fair price shop dealer. However, the learned Government Pleader for Civil Supplies (TS) has disputed this submission. Inasmuch as the learned counsel for the petitioner does not seek further adjudication of the writ petition on merits, irrespective of whether the petitioner has been appointed as permanent fair price shop dealer or not, the Writ Petition is closed without rendering any finding on the submission of the learned counsel for the petitioner that the petitioner has been appointed on permanent basis during the

pendency of this writ petition.

As a sequel to closure of the writ petition, interim order, dated 05.12.2009, as extended on 20.04.2010 in W.P.M.P.No.34663 of 2009 is vacated and W.P.M.P.No.34663 of 2009 filed by the petitioner for interim relief shall stand disposed of as infructuous.
