HON'BLE SRI JUSTICE S.V. BHATT W.P.No.1472 OF 2015 ORDER:

The subject matter of writ petition is premises bearing Door No.1-4-788/1, at Bakaram Village, Musheerabad Mandal, Hyderabad District.

The petitioner prays for Mandamus declaring the action of respondents in threatening to demolish the petition property without following due process of law, as illegal, arbitrary and unconstitutional. At the request of learned Government Pleader, the matter was adjourned to enable him to get instructions from the 2nd respondent. The written instructions received by the office of Government Pleader, Land Acquisition, are placed on record. The gist of written instructions is that the premises bearing Door No. 14-788/1, Bakaram Village, Musheerabad Mandal, Hyderabad, belonging to the petitioner, was not requisitioned by the ACP, CircleIX, GHMC, Hyderabad. Therefore, the subject premises was not notified for acquisition. In the event a requisition is received for the subject premises, the 2nd respondent would notify the same for acquisition. It is further stated that in the event of acquisition, the 2nd respondent will follow procedure stipulated by law. The stand of the respondents is placed on record.

The writ petition is, accordingly, closed, as no further orders are necessary. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
