Mudigindla Ravi Kumar v. The State Of Telangana,
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.19097 OF 2019 Date:30.08.2019 Between:
Mudigindla Ravi Kumar, S/o. M. Krishna, Aged 32 years, Occ: President, Maha Vinayaka Utsava Committee, Reg.No.1035/2019, Gandhi Chowk, Hasnabad Village, Kodangal Mandal, Vikarabad District, Telangana State .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Department of Home, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.19097 OF 2019 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Home appearing for respondents 1 to 5 and learned Government Pleader for Revenue for respondent No.6. 2.
Petitioner claims to be the President of Maha Vinayaka Utsava Committee, Gandhi Chowk, Mandapam No.5-11/2 of Hasnabad Village, Kodangal Mandal, Vikarabad District. The grievance of the petitioner, as evident from the complaint stated to have been lodged with the Sub-Inspector of Police dated 12.08.2019, is that few other persons have formed as an association and have erected idol of Lord Ganesh statue in the place where the association represented by the petitioner has been performing Vinayaka Chavithi festival celebrations. 3.
From a reading of the complaint, apparently it appears that there are rival disputes with regard to performing pooja of Lord Ganesh in nine days commencing from 02.09.2019. However, no material is placed on record to show that the subject land belongs to the petitioner to establish Mandapam to put up idol of Lord Vinayaka for performing pooja.
4.
Since there are rival disputes between two associations, the remedy is under civil law. The Court is not inclined to direct the respondents to involve in internal affairs of the petitioner and the unofficial respondent.
5.
The Writ Petition is accordingly dismissed. However, it is needless to observe that during festival season, the police shall ensure law and order. Pending miscellaneous petitions, if any, shall stand closed.
