THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19101 of 2019 ORDER:

The case of petitioner is that he purchased the land to an extent of Acs.3.07 guntas and Acs.3.07 guntas, in total Acs.6.14 guntas, in Survey Nos.232/A2 and 232/A3 respectively, situated at Manavapadu Revenue Village and Mandal, Jogulamba Gadwal Revenue District, through registered sale deeds bearing document No.6837 and 6838 of 2019 dated 20.04.2019. Thereafter, he made an attempt to cultivate the said land. Thereupon, the neighbouring land owners raised an objection by asserting that the said land belongs to them. As there was an ambiguity with respect to the boundaries, he approached the respondent authorities seeking to fix boundaries by undertaking survey of the land. As the same was not acceded to by the respondent authorities, he filed Writ Petition No.14913 of 2019 and this Court disposed of the same vide order dated 19.07.

2019 directing the authorities to take necessary action within eight (8) weeks from the date of receipt of the order. He asserts that he filed F-Line application as well as representation dated 22.04.

CKR, J W.P.No.19101 of 2019 respondent authorities are not considering the same. Hence, he filed this writ petition.

Learned Government Pleader points out that though the petitioner asserts that he submitted a representation on 22.04.2019 for mutation of his name in the revenue records, as per the procedure prescribed, he has to file online application, particularly, in Form-6A, and the same would be required to be processed by the authorities. As on date, the petitioner does not appear to have submitted the application in Form-6A, and as and when such application is filed, the same shall be dealt with by the seventh respondent - Mandal Surveyor, Manavapadu Mandal, Jogulamba Gadwal District, in accordance with law.

In those circumstances and inasmuch as there being no application in Form-6A submitted by the petitioner, as pointed out by the learned Government Pleader, liberty is given to the petitioner to submit the application in Form-6A for recording of his name in the revenue records under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. Thereupon, the same shall be considered and appropriate orders be passed within a period of three (3) months from the date of receipt thereof.

CKR, J W.P.No.19101 of 2019 procedure prescribed under the aforesaid Act and the Rules made thereunder and pass necessary orders in accordance with law. The writ petition is accordingly disposed of. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
