THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.611 of 2015 ORDER:
Upon hearing both sides, at the admission stage, the following order is passed:
It is informed by the learned Public Prosecutor that in this case charge sheet is filed by the police against the accused for the offences punishable under Sections 506 and 509 IPC. Hence, it is not a fit case to quash the proceedings since the allegations in the charge sheet, a copy of which is submitted by the learned Public Prosecutor, show a prima facie case against the accused. Hence, the petitioners/accused are directed to face the trial. However, considering the submission of the learned counsel for the petitioners that the first petitioner is an old person of 87 years and the second petitioner is a house wife, their appearance before the trial Court is dispensed with, except on the occasions when the trial Court requires their attendance.
Accordingly, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
