HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12673 OF 2004 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner is challenging the action of 1st respondent in releasing the entire retirement service benefits of the 2nd respondent, pending disputes between the petitioner and 2nd respondent and seeking a consequential direction to direct the 1st respondent to deposit 50% of the retirement service benefits of 2nd respondent in favour of the petitioner. A perusal of the record discloses that the Writ Petition against the 2nd respondent is dismissed for default, vide orders dated 29.12.2010 and the petitioner has not taken any steps to ensure that the Writ Petition against the 2nd respondent is restored. In the absence of 2nd respondent, this Writ Petition cannot be adjudicated on merits.

In view of the same, Writ Petition is dismissed. 3.
