THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24989 OF 2005 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue an order or direction more particularly, in the nature of writ of mandamus to declare the action of respondent No.1 in returning the first panel sent by respondent No.2 in the month of May, 2005 and subsequent action of respondent Nos.2 and 3 in sending the second panel by deleting the name of the petitioner and other candidates belonging to B.C. and S.C. as illegal and arbitrary and consequently, direct the respondents to appoint someone from the first panel to the post of Assistant Government Pleader in the Court of the Principal Senior Civil Judge, Kothagudem.

Today, when the matter is called, learned counsel for respondent No.3 submitted that the matter has become infructuous since the issue in this writ petition pertains to appointment of Assistant Government Pleader in the Court of the Principal Senior Civil Judge, Kothagudem for the period from 2005 to 2010 and the said period has already elapsed. 3.
Recording the said submission, this Court is of the view that nothing survives for adjudication in this writ petition and the writ petition is liable to be dismissed as infructuous. 4.
Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
