HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.A.No.17286 OF 2018 JUDGMENT: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present appeal, the appellants have challenged the order dated 11.04.2017 passed in W.P.No.18729 of 2012 by the learned Single Judge of this Court, whereby the appellant Corporation herein was directed to pay interest @ 9% p.a. for the delayed period of payment of retirement benefits.

Learned counsel appearing on behalf of the appellants submits that the JC & EOED found some stock shortages and short remittances during verification of the accounts from the month of July 2011 to November 2011. There is shortage of 1.403 meters rice and 0.280 meters of Batani. It is the duty and responsibility of Assistance Manager (accounts) to do monthly reconciliation of accounts of MLS points, LPG outlets, K.Oil outlets, MS & HSD outlets, Retail counters etc. every month both on quantitative and financial aspects, with reference to realization and remittances of sale proceeds in the banks and to notify any short remittances and shortage of stocks to the District Manager and initiate immediate action for its realization.

3. It is not in dispute that till date no departmental action has been taken against the respondent. The respondent was retired on 30.11.2011. Admittedly the retirement benefits were paid on 29.08.2012. The learned Single Judge directed the respondent corporation to pay interest @ 9% p.a. for delayed period of payment of retirement benefits.

4. In view of above, we find no ground to interfere with the impugned order dated 11.04.2017 passed in W.P. No.18729 of 2012.

5. Accordingly, the Writ Appeal is dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any pending, shall stand closed.
