HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21118 of 2002 ORDER:

Challenging the award dated 4.12.1999 passed in I.D.No.44 of 1997 by the 1st respondent-Labour Court, where no relief was granted in favour of the deceased employee, the present writ petition is filed.

The petitioners herein are the legal representatives of the deceased employee. The deceased employee filed I.D.No.44 of 1997 before the Labour Court challenging the order of removal, and during the pendency of the I.D., the employee died and his legal representatives were brought on record. 3.

The learned Counsel for the petitioners contends that the service benefits of the deceased employee for the service rendered by him prior to his removal may be directed to be paid to the petitioners.

This Court having considered the above submission is of the view that this writ petition can be disposed of directing the respondent-Corporation to pay the service benefits of the deceased employee for the services rendered by him prior to his removal, to the petitioners, if not already paid, within a

period of four weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to pay the service benefits of the deceased employee for the services rendered by him prior to his removal, to the petitioners, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
