HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 3172 OF 2015 ORDER:

The petitioner, who is an accused in Crime No.60 of 2015 of LMD Colony Police Station, Karimnagar District, preferred the present application under Section 438 Cr.P.C., seeking release in the event of her arrest in connection with the above crime, registered for the offences punishable under Sections 323 and 506 IPC and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (POA) Act, 1989. Though the present application is filed under Section 438 Cr.P.C., the learned counsel for the petitioner however seeks a direction to the Court concerned to consider his request for bail, at the earliest. It is to be seen that the offences under Sections 323 and 506 IPC are bailable and only the other offence alleged against the petitioner is under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (POA) Act, 1989.

Having regard to the circumstances of the case, the request of the petitioner in seeking a direction to the court concerned can be considered. Accordingly, the Criminal Petition is disposed of by directing the petitioner to surrender before the concerned court and move an application seeking regular bail before the appropriate court after giving prior notice to the Public Prosecutor in which event the concerned Court shall deal with the same in accordance with law on the same day or at the earliest.
