ORDER:
This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, "BNSS"), seeking grant of anticipatory bail.

The petitioner is the sole accused in FIR No.690 of 2026 on the file of the Miyapur Police Station, Cyberabad and registered for the offence punishable under Section 69 of the Bharatiya Nyaya Sanhita, 2023 (for short, "BNS").

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent-State. 4.
The case of the prosecution, in brief, is that the petitioner-accused on the false promise of love and marriage, sexually exploited the de-facto complainant/victim. Later, he refused for the marriage. Thus, a crime was registered against the petitioner.

Learned counsel for the petitioner would submit that the allegations levelled against the petitioner are unlikely goes to the age of the petitioner and the de-facto complainant, who are majors and also on the ground that the alleged occurrences were in the year 2023, and the police report was registered in the year 2026, that is nearly after lapse of one year. He further pleads that continuance of relationship itself is demonstrating the consensual nature. Howsoever, the petitioner is ready to cooperate with the investigation. He further submits that the complaint filed by the petitioner before the trial Court was dismissed without properly appreciating the orders of this Court in similarly placed cases. However, the petitioner is apprehending the arrest by the police, prays for grant of pre arrest bail.

Learned Assistant Public Prosecutor contends that the petitioner's relationship with the de-facto complaint is clear by the averments made in the complaint and the investigation is fire on stage. The statement of the victim/ de-facto complainant has been recorded and further investigation is pending and at this stage, granting pre-arrest bail to the petitioner may affect the investigation process and thus, prayed for dismissal of the petition.

I have perused the materials on record.

Having considered the allegations in the police report, the ages of the de-facto complainant/victim and the petitioner, and the timeline of the alleged relationship, this Court is of the view that the custodial interrogation may not be necessary. Further, as the petitioner is
undertaken to cooperate with the investigation, it is found proper to grant pre-arrest bail to the petitioner-accused.

Accordingly, this Criminal Petition is allowed. The petitioner shall be enlarged on anticipatory bail in the event of arrest, subject to the following conditions:
A. The petitioner/accused shall surrender before the Station House Officer, Miyapur, Cyberabad, on or before 02.07.2026. Upon such surrender, the Station House Officer shall release the petitioner on bail on execution of a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the said officer. B. The petitioner shall appear before the Station House Officer every Thursday between 11:00 AM and 02:00 PM for a period of ten (10) weeks and shall cooperate with the investigation. The petitioner shall also comply with the conditions envisaged under Section 482 of BNSS and any other conditions imposed by the Investigating Agency.
C. The petitioner shall furnish his residential address and contact details to the Investigating Officer and shall keep the same updated.
D. The petitioner shall not directly or indirectly tamper with the prosecution evidence or influence the witnesses in any manner.
