HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2148 of 2016 ORDER:

This revision is preferred challenging the docket order dated 02-02-2016 passed in C.C. No.3 of 2016 (Crime No.RC.No.10(S)/2013-CBI/VSKP) by the II Additional Judicial Magistrate of First Class, Kakinada, East Godavari District, wherein the learned Magistrate issued N.B.W. against petitioner-accused while taking cognizance for offences under Sections 6, 10(D) and 13 punishable under Section 23 of Foreign Contribution (Regulation) Act, and Sections 406, 409 and 420 IPC, and to quash the same.

The learned counsel for the petitioner submitted before this Court that the petitioner is ready to face the trial and he will not flee from the hands of justice.

Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that the criminal petition can be disposed of with the following directions: The petitioner-accused is directed to appear before the Court concerned and file a petition to recall the warrant issued against him and on such petition being filed, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum and further the petitioner is directed to appear before the trial Court regularly.

Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
