HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Petition No.3867 of 2017 ORDER:

In this petition filed under Section 438 Cr.P.C, petitioner/A1 seeks prearrest bail in Crime No.81 of 2017 of Narketpalli PS, wherein the petitioner along with other accused allegedly committed offences under Section 304B r/w 34 IPC.

2) The deceased is the wife of petitioner/A1. Their marriage took place on 11.03.2013 and as per the complaint allegations due to the harassment meted out to her by the accused for additional dowry, plots and car she committed suicide by hanging to fan on 01.04.2017 in her parental home. On the complaint given by the father of the deceased crime was registered and investigation is reported to be pending.

3) A perusal of CD file reveals a strong prima facie case against the accused which shows that only four witnesses were examined and investigation is still pending.

4) Having regard to the gravity of the offence and pending investigation and the petitioner/A1 is the prime accused, it is not a fit case to grant anticipatory bail to him. Hence, he is directed to surrender before the concerned Court and seek for regular bail.

5) The petition is accordingly dismissed.
