The petitioner challenges the seizure / sealing of his business establishment by name M/ s Down Town Hotel at H.No.8-2-703/ 4/ B/ 1A, Road No.12, Banjara Hills, Hyderabad, by the 3rd respondent, pursuant to the Notice dated 21.08.2019, without considering the documents provided by him in response to the earlier notices dated 02.07.2019 and 09.07.2019. Heard the learned counsel for the petitioner, and the learned Government Pleader for Municipal Administration and Urban Development. It is a case where, against the Notice dated 02.07.2019 issued under Section 521 and 622 (4) of the HMC Act, 1955, and the Show Cause Notice dated 09.07.2019 issued under Section 521 and 622 of the HMC Act, 1955, the petitioner submitted his explanation on 15.07.2019. However, without considering his explanation, the 3rd respondent sealed the business establishment of the petitioner.

Inasmuch as the grievance of the petitioner is with respect to nonconsideration of his explanation dated 15.07.2019 before effecting seizure of his business establishment, the writ petition is disposed of with a direction to the 3rd respondent-Zonal Commissioner to consider the explanation of the petitioner, dated 15.07.2019, and pass necessary orders in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. No costs.
