THE HON'BLE JUSTICE G.SRIDEVI CRIMINAL PETITION NO.5509 OF 2019 ORDER:
This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioners-A5 and A6, registered for the offences punishable under Sections 188, 270, 273, 328 and 420 r/w 34 IPC. 2.
Heard the learned counsel for the petitioners and the learned Addl. Public Prosecutor representing the State. 3.
Learned counsel for the petitioners submits that in a similar case, this Court by virtue of common order in Criminal Petition Nos. 3731 of 2018 and batch, quashed the proceedings against the petitioners therein by considering that transportation of Gutka is not attracted by the offences alleged under Sections 188,328 and 273 IPC and Food Safety and Standards Act. A perusal of the order shows that this Court by considering that transportation of Gutka does not attract the offences alleged, quashed the proceedings. Learned Public Prosecutor does not dispute the same.

Hence, following the said order and in terms thereof, the criminal petition is allowed and the proceedings against the petitioners-A5 and A6 in PRC No.5 of 2019 on the file of the I Addl. Judl. Magistrate of I Class,
Godavarikhani, for the offences punishable under Sections 188, 270, 273, 328 and 420 r/w 34 IPC, are hereby quashed. Miscellaneous petitions, if any pending shall stand closed.
