This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.113 of 2025 of Malakpet Police Station, Hyderabad District. The offences alleged against the petitioner are under Sections 232, 351(2) read with 3(5) of BNS.

Brief facts of the case are that the de-facto complainant lodged a complaint against the petitioner alleging that earlier a case in Crime No.376 of 2025 was registered against the petitioner under Section 74 BNSS and Section 9 read with 10 of the POCSO Act. It is further alleged that after coming out on bail in the said case, the petitioner was pressurizing the complainant and her daughter to withdraw the said case and on 24.03.2026, he threatened them to give false evidence in the said proceedings. It is further alleged that due to fear, the de-facto complainant's daughter gave false evidence stating that no offence was committed by the petitioner and as such, requested the Police to take necessary action against the petitioner.

Heard Sri Gouravulu Anil Kumar, learned counsel appearing on behalf of the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner contended that the petitioner is innocent of the said allegations. Earlier, a crime was registered in S.C.POCSO.No.478 of 2025 and the charge sheet was also filed in the month of December, 2025. As on today, the trial in the said case has not yet commenced and a false case has been

registered due to the threat of the petitioner. He is in jail since 02.06.2026. The entire investigation is already completed and no further incarceration is necessary. As such, he requested the Court to grant bail to the petitioner by allowing the criminal petition. 5.

On the other hand, the learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the petitioner is the father of the victim and that if he released on bail, he will try to influence the victim as well as the de-facto complainant and there is a threat both of them. Therefore, he prayed that this Court dismiss the criminal petition.

6. Considering the submissions made by both learned counsel and the material available on record, the petitioner herein has been in jail since 02.06.2026. The documents filed by the learned counsel for the petitioner show that the trial in S.C. POCSO No.478 of 2025 has not yet commenced. Considering the period of the petitioner's incarceration, this Court deems it fit to grant regular bail, subject to the following conditions: i. The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the VII Additional Chief Judicial Magistrate at Nampally, Hyderabad.

ii. The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of

charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii. The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
