ORDER

The writ petition is filed questioning the notice dated 15.09.2004 issued by the 3rd respondent in relation to revenue enquiry of illegal money lending business being carried on by the petitioner.

The writ petition came to be admitted on 8.2.2004.

Counter affidavit was filed on 28th July, 2010. In paragraph No.7 of the counter-affidavit, it is categorically stated that pursuant to the impugned notice dated 15.09.2004 issued by the 3rd respondent, the writ petitioner, in fact, appeared before the then Tahsildar on 29.09.2004 and had given evidence by way of statement with regard to the illegal money lending business.

Though the petitioner has challenged the summons issued, he, in fact, had obeyed and participated in the enquiry. In that view of the matter, nothing survives in the writ petition.

Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs. __________________________________ JUSTICE CHALLA KODANDA RAM
