THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.4538 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. challenging the order dated 05.05.2017 in Crl.M.P.No.1090 of 2017 in C.C.No.318 of 2017 on the file of the court of VI Additional Junior Civil Judge, Guntur.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to appear before the trial Court and file an application under Section 70(2) Cr.P.C. 3.

In view of the submission made by the learned counsel for the petitioner, the petitioner is permitted to withdraw the petition with a liberty to file a petition under Section 70(2) Cr.P.C. by appearing personally. If the petitioner appears and files such a petition, the trial Court is hereby directed to dispose of the same on the same day in accordance with law.

Accordingly, the Criminal Petition is dismissed as withdrawn. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
