ORAL ORDER:

Petitioners competed to the post of Forest Beat Officer. Petitioners were aggrieved by not considering their qualification of Diploma in Engineering from Polytechnic to participate in the selections to the post of Forest Beat Officer. In W P No 7486 of 2018, this Court, by order dated 1.5.2018, while permitting petitioners to participate in the selection process, directed respondents not to announce their final results and not to fill three posts until further orders. Similar order was made in W P No. 16933 of 2018 dated 2.5.2018 permitting the petitioner therein to participate in selection process and respondents were directed not to announce the final result of the petitioner and not to fill one post until further orders.

As per the recruitment notification, person possessing pass in Intermediate or equivalent qualification is eligible to compete to the post of Forest Beat Officer. Issue for consideration is whether Diploma in Engineering possessed by petitioners can be treated as equivalent to pass in Intermediate Education Course. Earlier petitioners claim was not considered by holding the qualification possessed by them as not equivalent.

Learned standing counsel for respondent -TSPSC, on instructions, submits that Government has now clarified that Diploma possessed by petitioners can be treated as equivalent to pass in Intermediate course of study and therefore, petitioners are eligible to participate in the selections.

Having regard to the same, writ petitions are allowed and respondent-TSPSC is directed to publish results of petitioners and if

petitioners secured merit, shall take further steps in the matter. No costs.
