THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6807 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.93 of 2023, on the file of Hathnoora Police Station, Sanga Reddy District, registered for the offences under Sections 498-A and 306 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The petitioner, who is the husband of the deceased was arrested on the ground that he harassed the deceased stating that she had taken gold chain from Almirah. Unable to bear the accusation of the petitioner/husband that chain was removed by her, she allegedly committed suicide. The petitioner is in jail since 13.06.2023. Even according to the Additional Public Prosecutor, 16 witnesses were examined.

Since most part of the investigation is complete and only charge sheet has to be filed, this Court deems it appropriate to grant relief of bail to the petitioner subject to the following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate-Cum-Special Mobile Court at Sangareddy District.

ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer every Monday between 10.30 AM and 01.00 PM till the date of filing of charge sheet or for a period of eight weeks, whichever is earlier from the date of this order. It is needless to say, he shall appear before the concerned Court for the purpose of completion of trial.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
