HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25401 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the sixth respondent in issuing proceeding for conduct of elections to the seventh respondent society as per elections notification in Rc.No.1/E.O. dated 24.07.2016 without taking the objections raised by the petitioners and similarly situated members dated 08.07.2016 as illegal, arbitrary and contrary to the provisions of the A.P.Co.operative Societies Act and rules made there under and consequently set aside the elections notification dated 24.07.2016.

Heard the learned counsel for the petitioners and the learned Government Pleader for Co.operation for the State of Andhra Pradesh. The only request made by the learned counsel for the petitioners' is that the representation submitted by the petitioners dated 08.07.2016 may be considered by the competent authority. Having regard to the facts and circumstances of the case and also the submissions made by both counsel, the sixth respondent is hereby directed to consider the representation of the petitioners dated 08.07.2016 as expeditiously as possible, in accordance with law. With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
