HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.19469 of 2019 ORDER:
Learned counsel for the petitioners placed on record Memo dated 24.02.2020.
From a perusal of the said memo, it is evident that the writ petitioners and respondent No.17 have settled the matter out of Court by entering into a memorandum of understanding dated 24.02.2020. Therefore, the petitioners seek permission of this Court to withdraw the writ petition without any prejudice to their tenancy rights over the lands in Sy.Nos.204, 208 and 209 to an extent of Ac.5.05 guntsa, Ac.18.11 guntas and Ac.1.30 guntas respectively, excluding the subject matter of the writ petition i.e., land admeasuring Ac.3.28 guntas in Sy.No.209 situated at Kuntloor Village, Abdullapurmet Mandal, Ranga Reddy District. Learned counsel appearing for the respondents opposed the said request on the ground that any liberty that will be given would amounts to creation of fresh cause of action for the petitioners.
Learned Government Pleader also requests that the Government may be allowed to raise objections for the layout that will be approved if the land belongs to the Government. Having heard both the counsel and from a perusal of the memo dated 24.02.2020, the request, as sought for, is accorded. Accordingly, the writ petition is dismissed as withdrawn.
Ac.3.28 guntas in Sy.No.209 situated at Kuntloor Village, Abdullapurmet Mandal, Ranga Reddy District. No order as to costs.
