THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.1930 of 2017 ORDER:

This Criminal Petition under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioners/A.2 to A4 on pre-arrest bail since they are apprehending arrest in connection with Crime No.32 of 2015 on the file of Airport Police Station, Visakhapatnam District, registered for the offences punishable under Sections 498-A IPC and Section 3 and 4 of DP Act and Section 3 (1) (x) of SCs and STs (POA) Act. After arguing the matter for a while, learned counsel for the petitioners requested this Court to permit the petitioners to surrender before the Special Court for trial offences under SCs and STs (POA) Act.

Acceding to the request of learned counsel for the petitioners, without going into the merits of the case, I deem it appropriate to permit the petitioners to surrender before the Special Court for trial offences under SCs and STs (POA) Act and on such surrender, if any application is filed under Section 437 and 439 Cr.P.C, the Presiding Officer is directed to decide the application filed by the petitioners on the same day in accordance with law.

With the above observation, this Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
