THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2534 OF 2016 ORDER:
This petition is filed by the petitioners-accused Nos.1, 2 & 4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.684 of 2015 on the file of the II Additional Junior Civil Judge-cum-XIX Metropolitan Magistrate, Kukatpally at Miyapur.
Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act. Considering the facts and circumstances of the case and the nature of the allegations, this Court is not inclined to interfere with the proceedings in the above C.C.
At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of petitioners No.2 and 3-A2 and A4 before the trial Court is dispensed with except on the dates, when their presence is specifically required by the trial Court. The 1st petitioner is directed to appear and represent petitioners 2 and 3-A2 and A4 in the above C.C. All the petitioners are directed to be represented through their Counsel on all hearing dates. Accordingly, the Criminal Petition is disposed of.
