ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.4 in Crime No.28 of 2026 before the Sultan Bazar Police Station, Hyderabad, registered for the offence punishable under

Sections 310(4), 109, 309(4), 311 read with 3(5) of BNS and Section 27 of Arms Act.

The brief facts of the case are that on 31.01.2026, the de facto complainant, a cloth merchant from Kerala, went to the SBI Main Branch ATM at Koti, Hyderabad, to deposit an amount of Rs.6,00,000/-. While he was depositing the cash, two unknown persons allegedly threatened him with a firearm, assaulted him, and fired two rounds at him, one of which struck his right leg causing injuries. The assailants allegedly robbed the cash bag containing Rs.6,00,000/- and the key of his vehicle and fled from the scene. Based on the statement of the injured complainant recorded at Osmania General Hospital, Crime No.28 of 2026 was registered for the offences punishable under Sections 310(4), 109, 309(4), 311 read with Section 3(5) of the BNS and Section 27 of the Arms Act. The petitioner was subsequently implicated as A-4 and was arrested on a PT warrant on 11.03.2026.

Heard Sri Mohd. Ghouse Pasha, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case and that no specific overt act has been attributed to the petitioner and that the prosecution story is fabricated and concocted. He further submits that the petitioner is a private employee, has no criminal antecedents, and is a permanent resident having roots in society. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposed the bail application contending that the petitioner is involved in a grave offence involving armed robbery and an attempt on the life of the de facto complainant and that the complainant sustained a gunshot injury during the commission of the offence and that the investigation has revealed the involvement of the petitioner along with the other accused in the crime. He further contended that the offences alleged are serious in nature and that releasing the petitioner on bail may adversely affect the investigation and prosecution. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since 11.03.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 23 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the II ACJM Nampally, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
