THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.36371 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner is aggrieved by inclusion of its property in the notification issued under Section 22-A of the Registration Act, 1908 (for short, 'the Act'). The petitioner contends that the property as claimed in this Writ Petition is a private property and as now the Government has interest in it, such inclusion of property in the prohibited list by the Revenue Divisional Officer, Butchirajapalem Village, Visakhapatnam Urban and Visakhapatnam District, the 5th respondent, is clearly erroneous.

Under Section 22-A (4) of the Act, the petitioner has an efficacious alternative remedy of seeking deletion of its property from the prohibited list by making an appropriate application.

The Writ Petition is accordingly disposed of giving liberty to the petitioner to make an appropriate application under Section 22-A (4) of the Act and if such an application is filed by the petitioner, the competent authority shall examine the same with reference to the records and take appropriate decision in the matter expeditiously.

The Writ Petition is accordingly disposed of. There shall be no order as to

costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
