Heard learned counsel for the petitioners and learned counsel for the respondents.

The present Writ Petition came to be filed seeking issuance of Certiorari calling for records and set aside the proceedings No.A/646/89, dated 16.08.2008, issued by the fourth respondent and the consequent issuance of pattadar pass books and title deeds in favour of respondent Nos.5 to 49 in respect of lands situated in Hakeempet bearing Survey Nos.131, 132, 144, 146, 126, 166, 143, 147, 145, 130, 120, 119, 141, 148, 149, 160, 114, 117, 161, 110, 182, 183, 176, 142, 159, 162, 128, 130, 66, 68, 226, 150, 128, 164, 73, 89, 156, 175 and 176 and the lands situated at Achampet bearing Survey Nos.48, 49, 52, 53, 89, 90, 94, 95, 98, 99 and 100 of Veldurthi Mandal, Medak District.

On 05.08.2009, this Court, while issuing rule nisi, ordered status quo to be maintained as to the nature and possession of the property and entries in the revenue records, until further orders.

A counter came to be filed by the respondents opposing the averments made in the Writ Petition. The main ground urged by the respondents is that the petitioners filed an appeal before the third respondent against the proceedings of

the fourth respondent and the same is pending consideration. It is stated that in view of the interim order of status quo passed by this Court, the proceedings before the Revenue Divisional Officer are stalled.

The material placed before the Court would show that the very same petitioners preferred an appeal before the RDO, Medak on 24.07.2009 and the same is still pending consideration. It is stated that in view of the interim orders passed by this Court, the RDO could not proceed further. Learned counsel for the petitioners submits that a direction may be given to the RDO to dispose of the appeal at the earliest.

Having regard to the facts and circumstances of the case and the request made by the petitioners, the present Writ Petition is disposed of directing the Revenue Divisional Officer, Medak to dispose of the appeal filed by the petitioners against the order of Tahsildar in proceedings Nos.A/646/89, dated 16.08.2008, at the earliest, preferably within a period of three months from the date of receipt of a copy of this order. Till such time, the interim order granted by this Court on 05.08.2009 shall continue. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________ JUSTICE C. PRAVEEN KUMAR
