HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL MISCELLANEOUS APPEAL No.915 of 2005 JUDGMENT : (per Hon'ble Sri Justice R.Subhash Reddy) Though the appeal is of the year 2005, respondent No.1 is not yet served. When the matter came up for hearing on 5.2.2015, learned counsel for the appellant was permitted to take out personal notice by registered post with acknowledgement due to the respondents and file proof of service within four weeks. Thereafter, when the matter was listed on 12.3.2015, as proof of service is not filed, the matter was directed to be listed under the caption "FOR DISMISSAL".
2. Even today, when the matter is taken up for hearing, there is no representation for the appellant and proof of service is also not filed.
3. In view of the same, this appeal is dismissed for non-prosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
