The Court made the following :

ORDER:

This Writ Petition is filed for a mandamus to set-aside proceedings in R.C.No.E/41/09, dated 9-2-2009 of respondent No.1 whereby he has suspended the petitioner's fair price shop authorization pending enquiry.

This Court by order dated 20-2-2009 while suspending the impugned order, directed the respondents to continue to supply essential commodities to the petitioner's shop. The learned Government Pleader for Civil Supplies (TS), on instructions, submitted that the enquiry has been completed and that in view of the interim orders of this Court, final order has not been passed.

In these facts and circumstances of the case, respondent No.1 is directed to pass a final order and communicate the same to the petitioner within one month from the date of receipt of this order. Till this process is completed, the petitioner shall be continued as the fair price shop dealer.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel to the disposal of the Writ Petition, WPMP Nos.4456 and 4457 of 2009 are disposed of.
