This writ petition is filed for the following relief: ..."to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the action of Respondent No 2 in not entering the correct date of birth of the Petitioner i.e. 01.06.1986 instead 14.04.1987 and also not issuing fresh passport with correct date of birth is illegal, arbitrary, null and void and consequently direct Respondent No. 2 herein to issue a fresh passport with the correct date of birth of the petitioner as 01.06.1986...."
Based on the instructions, learned counsel appearing for respondent No.2 submits that no application of the petitioner is pending with respondent No.2 and that as a matter of fact, even in the communication, dated 26.08.2016, the petitioner was informed that it would be open to him to file a fresh application for issuance of passport.
In those circumstances, the writ petition is disposed of leaving it open to the petitioner to submit an application before respondent No.2, who, in turn, shall consider the same, in accordance with law.
