THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2445 of 2017 ORDER:

This Criminal Petition under Sections 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioner/A.5 on pre-arrest bail since he is apprehending arrest in connection with Crime No.19 of 2017 on the file of PS Bellampally Town, Mancherial District, registered for the offences punishable under Sections 420, 471 r/w 34 IPC.

After arguing the matter for a while, learned counsel for the petitioner requested this Court to permit the petitioner to surrender before the Court concerned and direct the concerned Court to decide the application, if any, filed by the petitioner under Sections 437 and 439 Cr.P.C. on the same day. Acceeding to the request of learned counsel for the petitioner, without going into the merits of the case, I deem it appropriate to permit the petitioner to surrender before the Court concerned and on such surrender, if any application is filed under Section 437 and 439 of Cr.P.C, after serving notice on the Public Prosecutor, the Presiding Officer of the concerned Court is directed to decide the application filed by the petitioner on the same day in accordance with law.

With the above observation, this Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
